The Labour Court rules the AMCU cannot strike in the gold sector

In January, the Association of Mineworkers and Construction Union (AMCU) attempted to down tools at three gold producers as it began strike action in the platinum sector. The affected gold producers took the AMCU to court over the matter. They obtained an interdict preventing the AMCU from striking. Today, the Labour Court made the order permanent. The AMCU lose its battle to strike at gold mines

This morning, the Johannesburg Labour Court “made permanent its interim order preventing [the] AMCU from striking at certain gold mining operations,” reports IOL. The gold producers involved are Sibanye, Harmony and AngloGold Ashanti.

In January, the AMCU said it wanted to strike in demand “for higher salaries,” says BDLive. The AMCU was the only union out of the main four that didn’t back a “two-year wage deal” agreed last year.

The National Union of Mineworkers (NUM), Solidarity and the United Association of South Africa signed the new deal, says Mining Weekly. At that time, they “represented 72% of employees”.

At the beginning of the month the Labour Court told the AMCU it had to prove why the court shouldn’t make the interim order a permanent one.

The order preventing strike action is now permanent

Labour Court judge, Andre van Niekerk, made the interim order a final order at a hearing today, notes Bloomberg.

Elize Strydom of the Chamber of Mines, who represents the producers, says “the gold industry has always concluded wage negotiations at a centralised level and the process has always been inclusive and fair,” adds BDLive. She says they will continue this process going forward “with the elective representatives of employees”.

So, for now, the AMCU has lost its battle against some of the gold producers over strike action.
